USE OF SPECIFIC KNOWLEDGE IN FORENSIC ACTIVITY: THEORETICAL AND LEGAL ASPECTS

The purpose of the article is to reveal the substance of forensic activity in modern conditions and to find out the essence of specific knowledge in the context of their use by a forensic expert. Methodology. The reliability of the obtained results and conclusions is ensured by the application of a comprehensive systematic approach to solving research problems. In particular, the system-structural method clarifies the essence of the studied categories and legal phenomena, their element-component content. With the help of scientific abstraction method, standpoints were drawn on the content of forensic activities and specific knowledge; proposals for the legislation improvement were made, given the expediency of introducing the institute of an expert in the field of law and in criminal proceedings. Regulatory provisions on the researched topic were analyzed using method of logical-argumentation. Scientific novelty. Research conclusions on the content and essence of forensic activity allowed to substantiate the standpoint, according to which forensic activity should be understood as a set of organizational, procedural, scientific, methodological and other measures aimed at establishing factual data using specific knowledge in the field of science, technology and arts relevant for decision-making in criminal, civil, commercial, administrative proceedings, for administrative offense cases, as well as for enforcement proceedings. Conclusions. In the course of the research the correlation and interrelation of specific and general knowledge was determined; the essence of specific knowledge of forensic expert was revealed as a complex concept; the possibility of legal knowledge application by a forensic expert was clarified; the substance of forensic activity was highlighted and the author's vision of its content was offered.
