Abstract

The purpose of the article is to scientifically substantiate the possibility and expediency of conducting forensic examinations (expert research), the object of which are live animals, by specialists of expert specialty 12.1 «Determining the value of machinery, equipment, raw materials and consumer goods». Methodology. The reliability of the obtained results and conclusions is ensured by the use of general (general scientific) and special methods of cognition (thought experiment, idealization, formalization, generalization, convergence (used on the border of different branches of knowledge – in this article: biology, jurisprudence, commodity studies). The systematic approach made it possible to study in the theoretical plane the subject of this research, which belongs to the category of complex in number characteristics (indicators of properties) that form its market value. Scientific novelty of the article: for the first time in the practice of forensic commodity examination the objects of animal origin are considered as objects of research by specialists of expert specialty 12.1. Conclusions. In the process of consideration of the issue, a comprehensive analysis of regulations related to the practical activities of the Expert Service of the Ministry of Internal Affairs, which interpret the concepts related to the research topic and regulate the procedure for determining the market value of property, was carried out; the international experience on the outlined problems was generalized. It is emphasized that the current regulations differently define and interpret the names and nomenclature of objects that are provided for examination by forensic experts. The statement that live farm animals are movable property is substantiated, and on this basis not only the possibility but also the expediency of conducting forensic examinations (expert studies), the object of which are live farm animals, is proved by specialists of expert specialty 12.1 «Determining the value of machines, equipment, raw materials and consumer goods», and it is established that live farm animals, as a biological object, in order to determine the biological characteristics, are the object of study by experts specialty 9.2 «Research of objects of animal origin».
