Abstract

The author clarifies the legal nature of the professional ethics of the forensic expert. It is defined by the professional duty, which must be based on moral norms of behavior during performance of official duties and professional honor, which reflects the moral norms aimed at realization of the general principles of forensic expert activity. The statutory and regulatory regulation of the professional ethics of the forensic expert is outlined in the article. The necessity of adopting a statutory act regulating professional ethics in the forensic examination and the mechanism for enforcing legal liability for its violations is proved. The author gives proposals on improving valid legislation of Ukraine in the field of forensic examination, which foresee the creation of the Ethics Code of forensic expert, as well as the creation of the Chamber (Association) of forensic experts. The competence of these experts will be a matter of effective and prompt response to the violation of the rules of professional ethics by the other colleagues.
