DETECTION AND INVESTIGATION OF CRIMINAL OFFENSES AGAINST MORALITY: SEARCH MEASURES AND EXPERT SUPPORT

The purpose of the article is to determine the features of search activities which are carried out during the detection of criminal offenses against morality, and expert support of their investigation within the interaction of the relevant units, to provide suggestions for improving such activity. Methodology. To study the organizational and technical principles, provisions and principles of the introduction of modern means of communication as the main used dialectical method, which allowed to consider the subject of the article in the aggregate and the relationship of its components. In addition, the tasks set to achieve the purpose have been solved by using a set of general scientific and special methods, including formal and logical (analysis, synthesis, deduction, induction, analogy, abstraction), systematic and structural, comparatively legal methods. Scientific novelty. Some directions and proposals have been formulated to improve the search measures carried out during the detection of criminal offenses against morality, and expert support of their investigation within the interaction of relevant units, which will help to solve one of the main tasks of criminal proceedings – ensuring fast, complete and impartial criminal investigation of the offenses. Conclusions. The formulated proposals for improving the activities of the relevant units include the necessity to: develop, basing on the practice of investigative measures in criminal proceedings against morality, legislative proposals to expand the use of operational and search measures and covert investigative actions during their investigation; to single out, taking into account the experience and tendencies of counteraction to criminal offenses against the morality of the developed countries of the world, new, unidentified threats and to find their place in the legal field of Ukraine; to determine the priority areas of proceedings and expansion of the list of forensic examinations types in expert institutions, taking into account the needs of the practical investigation of criminal offenses against morality; to direct the efforts of scientists, forensic experts to develop new and improved existing methods of researching a certain types of objects, in particular those that must be examined during the investigation of criminal offenses against morality, taking into account the needs of practice, statistics and legislative novelties which define a new type of the offenses of the studied category. The proposals seem to be discussed, but some of them may be a part of the relevant guidelines, despite the lack or obsolescence of research methods for certain types of objects, especially for relatively new types of offenses, including against morality, which the legislator criminalizes basing on of nowadays realities and world practice.
